No, recreational use is not legal in Oklahoma.
Does Oklahoma have a medical program?
Yes, medical cannabis is legal in Oklahoma. OK voters passed SQ 788 on June 26, 2018, making medical marijuana legal in the state.
SQ 788 states that Oklahomans with serious medical conditions can officially use medical marijuana to treat those conditions if they sign up for the state’s medical marijuana program.
What are the rules for medical use?
Individuals residing in Oklahoma who have medical cannabis certifications from licensed medical professionals stating that they have severe medical conditions can receive medical marijuana.
Patients can use the OMMA Thentia licensing site to apply for medical marijuana cards online. Telemedicine can be used to give medical marijuana suggestions to patients. So, in Oklahoma, the whole process of getting a medical marijuana card can be done online.
Oklahoma’s medical marijuana program allows visitors and patients from other states to get medical marijuana in Oklahoma. Temporary residents of Oklahoma may be able to get and use medical marijuana if they apply for and are approved for a temporary adult patient card.
You need to show your medical marijuana patient card and another form of ID whenever you go to an Oklahoma-licensed dispensary to buy medical marijuana. Dispensaries that sell medical marijuana in Oklahoma can check your OMMA registration by looking at your medical marijuana ID card or the state’s database. Patients under the age of 18 will not be able to enter a medical marijuana dispensary without a parent or legal guardian.
Residents under the age of 18 can get a special medical marijuana minor patient license from the OMMA. Like adults who use medical marijuana, minors must get medical marijuana certifications from approved doctors before they can get medical marijuana. In contrast to adults who use medical marijuana, recommendations must come from two approved doctors, not just one.
After getting recommendations from doctors who are accepted, a minor must also get their parent or legal guardian to sign their application. Only then can it be approved.

The state does not have a list of approved medical conditions. However, here are some common illnesses and conditions for which people get permission to use medical marijuana:

What are the medical program limits?
People with an Oklahoma medical marijuana card can buy up to 3 ounces of non-concentrated marijuana, 8 ounces of marijuana flower to grow at home, 72 ounces of edible or topical marijuana, 1 ounce of concentrated marijuana, 6 growing marijuana plants, and 6 seedlings.
What methods of use are permitted under the medical program?
Minors who are legally allowed to use medical marijuana can’t smoke it or vape it unless both of their doctors agree that it is medically necessary.
Medical equipment that can be aerosolized and nebulizers can be used.
Is there home delivery for medical cannabis?
At the moment, Oklahoma doesn’t have any services that deliver cannabis. A lot of medical cannabis dispensaries in Oklahoma let people order medical cannabis products online. The buyers must then pick up their orders at one of the dispensaries’ in-store or curbside sales areas.
Is CBD legal in Oklahoma?
Yes, CBD is legal in Oklahoma. The Oklahoma Agricultural Industrial Hemp Pilot Program (HB 2913), which was passed in 2018, makes it legal to grow and sell industrial hemp in the state. In Oklahoma, it is legal to own, sell, and use CBD oil that comes from industrial hemp.
However, it is against the law to have CBD oil made from marijuana without a license. CBD oil made from marijuana can only be bought by approved medical patients.
Is cannabis decriminalized in Oklahoma?
No, cannabis is not decriminalized in Oklahoma.
Having marijuana without a license is a misdemeanor in Oklahoma, according to Title 63 §2-101 (Uniform Controlled Substances Act). People who violate the law can get at least one year in jail and a $1,000 fine. For first-time offenders, conditional release is an option. If you are caught with up to 1.5 ounces, you could be fined up to $400.
You also can’t do it within 1,000 feet of schools, public parks, or when there are children (under 12 years old). If you do, you could get a $2,000 fine, two years in prison, or both. There is also a $100 special assessment trauma care fee that goes into the Trauma Care Assistance Revolving Fund.
It is also a misdemeanor to have marijuana paraphernalia on your person. You could get a $1,000 fine, a year in jail, or both.
