Does New Jersey have a recreational use program?

Yes, recreational use is legal in New Jersey. Enacted by Assembly No. 21, the New Jersey Cannabis Regulatory Enforcement Assistance Marketplace Modernization Act permits adults 21 years of age and older to possess and use cannabis recreationally in the state.

On February 22, 2021, Governor Phil Murphy signed this cannabis reform bill into law.

 

Does New Jersey have a medical program?

Yes, medical cannabis is legal in New Jersey. The Compassionate Use Medical Marijuana Act (CUMMA), which was passed by the state legislature in January 2010, authorized medical marijuana in the state of New Jersey. Residents of New Jersey are now able to use medicinal marijuana to treat certain ailments, including terminal illnesses.

The New Jersey Medical Marijuana Program (NJMMP) was created by CUMMA, and the Cannabis Regulatory Commission (CRC) was permitted to manage the Program.

 

What are the rules for medical use?

To be authorized to use medical marijuana in New Jersey, an individual must meet certain requirements, including being a resident of the state, being 18 years of age or older, and having a medical condition that meets the program’s qualifying conditions as determined by a certified healthcare provider.

In New Jersey, you can apply for a medical marijuana card while relaxing in your own home. According to state regulations, qualified patients can use telemedicine to get recommendations for medical cannabis and can fill out the remaining application online through the New Jersey Medical Cannabis Program website.

To be eligible for a permanent medical cannabis card in the state of New Jersey, you must be a resident there legally. On the other hand, you might be eligible for temporary registration if you are a visiting patient from another state.

Filling your orders requires you to bring your medical marijuana cards and a state-issued identification card to an authorized dispensing facility. For minors to use medical marijuana legally in New Jersey, they must be diagnosed with a chronic illness that qualifies under the state’s medical cannabis laws, and they must name an adult caregiver to assist in obtaining and managing the medication.

What are the medical program limits?

Patients with terminal illnesses are exempt from this monthly cap and are permitted to possess up to 3 ounces of cannabis per 30 days with a valid medical marijuana card from New Jersey. The patients’ medical professionals determine the dosages.

With a valid caregiver card issued under the New Jersey Medical Cannabis Program, the designated caregiver of a patient who is homebound or a minor may purchase and deliver up to 3 ounces of cannabis per month to the patient.

 

What methods of use are permitted under the medical program?

New Jersey allows medical marijuana in the following forms: vape, flower, oil, topicals, and oral lozenges.

 

Is there home delivery for medical cannabis?

Yes. In New Jersey, the delivery of medical marijuana is permitted under A20, also known as Jake’s Law.

With its CREAMM Act, New Jersey also established a cannabis delivery license that would enable the delivery of cannabis for recreational use. But as of June 2023, no license has been granted to permit the state to lawfully deliver cannabis for recreational purposes.

 

Is CBD legal in New Jersey?

Yes, CBD is legal in New Jersey. The New Jersey Hemp Farming Act (New Jersey Assembly Bill 5322) states that cannabinoids derived from hemp, such as CBD, are not classified as controlled substances but rather as agricultural commodities. This suggests that CBD products like gel, capsules, and oil are acceptable in New Jersey.

CBD derived from marijuana is also permitted in the state.

 

Is cannabis decriminalized in New Jersey?

Yes, cannabis is decriminalized in New Jersey.

In New Jersey, those who are at least 21 years old are allowed to possess up to 6 ounces of cannabis. Anything beyond that, though, is forbidden and will result in both a fine and jail time.

Adults who possess more than six ounces of cannabis face a fourth-degree offense that carries a maximum punishment of $25,000 and an 18-month jail sentence. The offender will receive an extra 100 hours of community service and an additional fine if they are discovered within 1000 feet of a school.

If marijuana is found within 1,000 feet of a school, the punishment will include an additional 100 hours of community service and a varying fine based on the amount found.
