Does Massachusetts have a recreational use program?

Yes, recreational use is legal in Massachusetts. The Massachusetts Marijuana Legislative Initiative (Question 4) made marijuana use for recreational purposes legal in 2016. As a result, the Massachusetts law known as An Act to Ensure Safe Access to Marijuana was passed.

The Act permits anybody over 21 to lawfully acquire, own, cultivate, give as gifts, and transport small amounts of marijuana.

 

Does Massachusetts have a medical program?

Yes, medical cannabis is legal in Massachusetts. After people in Massachusetts voted yes on Question 3 of the 2012 ballot initiatives on November 6, 2012, the state could legally use medical marijuana.

Chapter 369 of the Massachusetts General Laws (An Act for the Humanitarian Medical Use of Marijuana) sets the rules for this program. It lets people with certain medical illnesses use cannabis products for medical reasons.

 

What are the rules for medical use?

Chapter 369 of the Massachusetts General Laws says that someone with an acceptable medical condition can become a medical marijuana patient through the state’s medical marijuana program.

Massachusetts patients and providers who are registered for medical marijuana can legally buy cannabis products from registered medical marijuana treatment centers for medical use. Medical marijuana cards in Massachusetts can only be given to people who qualify and live in Massachusetts. During their application for a medical marijuana card, they have to show proof that they live in Massachusetts.

Before giving out cannabis goods to customers, Massachusetts’ licensed medical marijuana treatment facilities typically check the state’s medical marijuana registry database to confirm the buyers’ identities. When buying marijuana products from licensed medical marijuana treatment centers in Massachusetts, registered medical marijuana patients and caregivers must show their registration cards and a legal photo ID from the government.

What are the medical program limits?

With a Massachusetts medical marijuana card, a registered cannabis patient can buy up to 10 ounces of cannabis, which is enough for 60 days, based on the prescription from their doctor.

 

What methods of use are permitted under the medical program?

Retail stores and treatment centers that are licensed to sell marijuana can sell buds, raw pre-rolls, concentrates, vape products, and edibles, among other types of marijuana products. But all sales must follow the rules set by the Commonwealth.

Each purchase can only include 1 ounce of marijuana and 5 grams of concentrates. Each serving of marijuana sold in stores can only have 5 milligrams of THC, and no more than 20 doses can be bought at once.

 

Is there home delivery for medical cannabis?

People in the state can order marijuana to be delivered to their homes from dispensaries or online shops. Residents of Massachusetts who use marijuana delivery services must follow the state’s rules. For example, they must be pre-registered with a medical or recreational cannabis dispensary and pay for their marijuana goods with cash or a debit card.

Delivery companies are required by law to give marijuana products to the people who made the orders after checking their IDs to identify their identity and that they are over the age of 21.

 

Is CBD legal in Massachusetts?

Yes, CBD is legal in Massachusetts.

CBD oil made from hemp, which is CBD oil with 0.3% THC or less, is allowed in the state.

Massachusetts’ medical marijuana program has been around since 2012, and its adult marijuana program has been around since 2016. Because of this, marijuana and products made from it are allowed in Massachusetts for both medical and recreational use. CBD oils that have more than 0.3% THC by weight are included in this.

 

Is cannabis decriminalized in Massachusetts?

Yes, cannabis is decriminalized in Massachusetts.

Legally, any adult in the Commonwealth who is at least 21 years old may possess up to one ounce of marijuana. Marijuana possession charges may be brought against someone found in possession of more marijuana than is authorized.

In Massachusetts, possessing more marijuana than is permitted by law is typically a misdemeanor. First-time offenders face a misdemeanor charge, which carries a maximum penalty of $500 in fines and six months in jail. Repeat offenders face severe punishments including up to two years in prison and a $2000 fine.
