No, recreational use is not legal in Kentucky.
Does Kentucky have a medical program?
Yes, medical cannabis is legal in Kentucky. On March 31, 2023, Governor Beshear signed SB 47 into law, legalizing medical marijuana in Kentucky. But SB 47 won’t go into effect until January 2025, at which time the Commonwealth Medical Cannabis Program will be set up.
What are the rules for medical use?
Kentucky is still in the process of developing its medical cannabis program. However, In November 2022, the governor of the state released an executive order that let people with at least one of the qualified medical conditions get medical cannabis from other US states.
Patients must get written permission from licensed doctors before they can buy cannabis in other states where it is allowed to use and buy marijuana. There will be no changes to the executive order until the Kentucky Medical Cannabis Program starts taking applications for medical marijuana cards.
What are the qualifying medical conditions for eligibility?
According to SB 47, people in Kentucky who have the following medical illnesses can get medical marijuana:
- Any type or form of cancer, regardless of stage;
- Chronic or debilitating pain, epilepsy or any other seizure disorder;
- Multiple sclerosis, muscle spasms, or spasticity;
- Chronic nausea or cyclical vomiting syndrome that has been proven resistant to other conventional medical treatments;
- Post-traumatic stress disorder; and,
- Any other medical condition or disease that the Kentucky Center for Cannabis determines.

Is CBD legal in Kentucky?
Yes, CBD is legal in Kentucky. Products made from hemp, like CBD oil, are allowed in Kentucky as long as they follow federal rules.
The 2017 Kentucky Farm Bill (HB 333) was signed into law before the 2018 Farm Bill. Kentucky’s HB 333 made it legal to buy, use, and sell hemp and goods made from hemp, such as CBD oil with no more than 0.3% THC.
On the other hand, it is against the law in the state to sell or use CBD oil that comes from marijuana.
Is cannabis decriminalized in Kentucky?
No, cannabis is not decriminalized in Kentucky.
In Kentucky, it is a Class B offense to carry up to 8 ounces of marijuana. You can get a $250 fine or 45 days in jail for this crime.
