Yes, recreational use is legal in Illinois. Recreational marijuana use was legalized in early 2020, marking a significant milestone for Illinois. It stands as the first state to legalize cannabis for recreational purposes through legislative action rather than a ballot measure.

This accomplishment positions Illinois as the eleventh state among all U.S. states to legalize recreational marijuana. Adults aged 21 and above in Illinois can purchase marijuana products from licensed dispensaries, even without holding a medical marijuana card.

 

Does Illinois have a medical program?

Yes, medical cannabis is legal in Illinois. In 2014, Illinois legalized medicinal marijuana for patients who met certain requirements.

Medical patients registered with the state may lawfully use medical marijuana on a doctor’s recommendation following the Compassionate Use of Medical Cannabis Pilot Program Act.

 

What are the rules for medical use?

In Illinois, residents seeking access to medical marijuana must obtain a medical marijuana card, which certifies that they have a qualifying medical condition warranting marijuana treatment. Obtaining this card involves seeing a physician for a medical cannabis certification.

What are the medical program limits?

People in Illinois who have medical marijuana cards can buy up to 71 grams, or 2.5 ounces, of marijuana every 14 days.

State law also lets patients with current registrations have more marijuana on hand if they need it, as long as their certifying doctors say it’s okay.

The law in Illinois says that you can’t buy more than 30 grams of cannabis. If someone is caught with 30 to 100 grams of marijuana, they will be charged with a crime. For this crime, you could get a fine of up to $2,500 or go to jail for a year.

If someone is caught carrying between 30 grams and 100 grams of drugs again, they are guilty of a crime that can get them up to 3 years in prison and fines of up to $25,000. It is also a crime to have more than 100 grams of weed on you.
