No, Puerto Rico does not have a recreational use program.

 

Does Puerto Rico have a medical program?

Yes, medical cannabis is legal in Puerto Rico. In 2015, Puerto Rico legalized medical marijuana after Governor Alejandro García Padilla approved the Medical Cannabis Act.

 

What are the rules for medical use?

Puerto Rican marijuana regulations indicate that the only people who can buy medical marijuana from a state-approved dispensary are those who are at least 21 years old, have been certified by a licensed physician, and have received a medical cannabis ID card from the Department of Health.

Marijuana sales to people younger than 21 and marijuana usage or possession without a medical cannabis ID card are still prohibited in Puerto Rico.

What are the medical program limits?

The daily allowance for registered patients is one ounce (28 grams) of a flower. The maximum is 8 grams if you’d rather take it as edibles or THC concentrate. This is only allowed for a maximum of 30 days at a time and is also monitored.

 

What methods of use are permitted under the medical program?

While smoking is not allowed, there are several acceptable forms of consumption, including:

  • Capsules or tablets
  • Concentrates
  • Edibles
  • Oil
  • Oral drops
  • Oral inhalers
  • Suppositories
  • Topical ointments and creams
  • Transdermal patches
  • Vaporization of cannabis flower or concentrate
  • Any other means that the Department of Health authorizes

 

Is there home delivery for medical cannabis?

Some websites provide patients with medical cannabis home delivery services.

 

Is CBD legal in Puerto Rico?

Yes, CBD is legal in Puerto Rico. As long as the CBD is made from hemp, has less than 0.3% THC, and satisfies all labeling and testing regulations, it is legal in Puerto Rico.

This complies with federal law as outlined in the USA Farm Bill of 2018.

 

Is cannabis decriminalized in Puerto Rico?

No, cannabis is not decriminalized in Puerto Rico.

For a first violation, any amount can result in a felony conviction, up to five years in jail, and $5,000 in fines. Recurring violations result in a maximum 10-year prison sentence and an additional $5,000 being added to the pool.

Distribution is categorized as a criminal offense. First-time offenders face a maximum fine of $20,000 and a term of up to 20 years in jail. Repeat offenders face a maximum sentence of 40 years in jail and penalties of $30,000.

You might face a five-year prison sentence and a $5,000 fine in addition to being charged with a felony if you are found in possession of marijuana paraphernalia, such as bongs or pipes.
