No, Peru does not have a recreational use program.

 

Does Peru have a medical program?

Yes, medical cannabis is legal in Peru. The Peruvian government under President Pedro Pablo Kuczynski announced plans to legalize medical marijuana in 2017.

In February 2019, these regulations came into effect.

 

What are the rules for medical use?

The government put laws into place that permit the production, selling, and growing of cannabis for medical use. Cannabis-based medicines are available to patients with qualified medical conditions upon prescription from licensed healthcare providers.

The medical cannabis program is supervised by the Ministry of Health, which also ensures appropriate quality control and regulations.

The country’s law initially classified cannabis as either psychoactive or non-psychoactive according to its THC content, with the latter having less than 1% per dry weight.

 

What are the qualifying medical conditions for eligibility?

Medical cannabis is approved for the treatment of several illnesses, including Parkinson’s disease, cancer, severe epilepsy, and chronic pain.

While non-psychoactive cannabis goods just need lab testing documentation, psychoactive cannabis products would now need to be officially certified and have a certificate of laboratory analysis before they can be imported.

For those who require THC concentrations of more than 1%, a specific medical prescription is required; this prescription may only be good for 30 days.

Non-psychoactive cannabis products could be obtained with a standard medical prescription. Patients may now grow their own for personal use if they are enrolled in the National Registry of Cannabis and Derivatives Users Patients for Medical and Therapeutical Purposes (RENPUC).

Is CBD legal in Peru?

Yes, CBD is legal in Peru. Products containing CBD that are made from industrial hemp and have less than 0.3% THC concentration are legal in Peru as long as they are used for medical reasons and are monitored by a qualified practitioner.

With a prescription from a physician, patients can lawfully purchase cannabis or cannabis oil (including CBD oil) from regulated dispensaries for medical use.

Purchasing cannabis products containing more than 1% THC requires additional paperwork.

 

Is cannabis decriminalized in Peru?

Yes, cannabis is decriminalized in Peru. Small amounts of cannabis used for personal consumption can be possessed without being prosecuted. However, the amount of cannabis that is lawful for personal possession is limited, and it is still illegal to sell or distribute cannabis.

Despite being decriminalized, it’s important to remember that driving while high on cannabis and consuming it in public is still forbidden and may result in fines or other consequences.
