Does Mexico have a recreational use program?

Yes, Mexico has a recreational use program. The Supreme Court of Mexico legalized marijuana for adult consumption on June 28, 2021. State and federal penal laws, however, are still in effect while the Mexican Congress works to eliminate any references to punishment and straighten up any discrepancies.

There is now no legal framework permitting the lawful sale of marijuana, and neither are there any laws for its commercial production and growth. 

Does Mexico have a medical program?

Yes, medical cannabis is legal in Mexico. A bill allowing the medical use of cannabis products having less than 1%THC was signed into law by President Enrique Peña Nieto in June 2017.

 

What are the rules for medical use?

Cannabis prescriptions must be written in accordance with the General Health Law’s regulations. To prescribe cannabis medications, medical professionals must have a bar code for special medical prescription formats, and pharmacies must maintain track of the patients who use their products.

 

What are the qualifying medical conditions for eligibility?

As of now, there are no clear rules yet about how medical cannabis will be regulated.

What are the medical program limits?

A permit from the National Commission Against Addictions is needed for personal use. Six plants may be grown for personal use with this permission, and eight plants may be grown in homes with more than two individuals. The limit for cannabis possession and transportation is 28 grams.

Is CBD legal in Mexico?

Yes, CBD is legal in Mexico.

Patients in Mexico can lawfully purchase CBD as a food supplement until the government completes the rules defining which cannabis products are acceptable and in what quantities.

Products can be transported into Mexico and sold in retailers there as long as their THC content is less than 1%.

 

Is cannabis decriminalized in Mexico?

Yes, cannabis is decriminalized in Mexico. Since marijuana was decriminalized nationwide in 2009—along with small amounts of several other drugs—personal possession of up to 5 grams of cannabis is essentially legal.

The law states that anyone found to be in possession of less than five grams of cannabis should be encouraged to enroll in free treatment programs.
