Does Brazil have a recreational use program?

No, Brazil does not have a recreational use program. The Federal Law of Brazil prohibits the growing, planting, and harvesting of drugs unless they are used for research or medicinal purposes. 

 

Does Brazil have a medical program?

Yes, medical cannabis is legal in Brazil. The production, distribution, and importation of cannabis-based medications are all legal under Brazilian federal law considering that the Ministry of Health has approved them.

As of 2015, terminally ill patients or those who ran out of other therapeutic options may receive a prescription for cannabis drugs with more than 0.2% THC in Brazil.

What are the rules for medical use?

Only medical professionals who are legally licensed in Brazil and in charge of the patient may prescribe cannabis products. To use cannabis products, patients or their legal representative must also sign an Informed Consent Form (TCLE).

 

What are the qualifying medical conditions for eligibility?

Products containing more than 0.2% THC may only be recommended for palliative care to individuals in terminal or irreversible clinical conditions who have no other therapeutic options. Palliative care is characterized by comprehensive and proactive therapy for patients whose illnesses do not respond to curative measures.

Yes, CBD is legal in Brazil. Since 2015, CBD oil has been allowed in the country and is subject to the standard rule that prohibits it from containing more than 0.2% THC.

Yes, cannabis is decriminalized in Brazil. Small amounts of cannabis possession are no longer illegal in Brazil. The Brazilian Supreme Court decided in April 2021 that it shouldn’t be illegal to possess small amounts of drugs for personal use, including cannabis.
